High-Risk AI Systems Under the EU AI Act: What CISOs and DPOs Need to Prepare

If your organization builds or uses AI that touches hiring, education, critical infrastructure operations, essential services, law enforcement-adjacent use cases, migration, or judicial processes, you should assume one thing upfront: the EU will treat certain AI systems less like “software features” and more like regulated products. That is the mental model shift.
The EU AI Act is written to make high-risk AI auditable, documented, monitored, and governable over its full lifecycle—not just at go-live. 
For CISOs and DPOs, this lands squarely in your world because high-risk AI is where security controls, privacy controls, and governance controls stop being “nice to have” and become operational requirements with deadlines.

1) First, know what “high-risk” means in practice

High-risk AI under the EU AI Act generally shows up in two ways:

  1. AI that is a safety component of regulated products (think medical devices, machinery, vehicles—areas governed by EU product legislation). These have special treatment and longer transitions in some cases. 
  2. AI systems used in the Annex III use cases—the list that explicitly classifies certain uses as high-risk, including biometrics, critical infrastructure, education, employment, essential services, law enforcement, migration/asylum, and justice/democracy-related contexts. 
A useful way to explain this internally: If the AI output can materially affect someone’s rights, livelihood, access, safety, or legal status, expect high-risk scrutiny.

The classification trap CISOs/DPOs see too late
Many organizations misclassify because they look only at the model type (“it’s just an LLM”) instead of the use. Under the Act, the same underlying technology can be low-risk in one context and high-risk in another.

Example: “AI that ranks candidates” is not the same as “AI that drafts interview questions.” Both can create issues, but the first is far more likely to land in high-risk territory because it influences employment outcomes.

2) Timelines: when these stops being “future work”

The European Commission’s own timeline summary is clear:

  • The AI Act entered into force on 1 August 2024 and is fully applicable from 2 August 2026, with staged dates. 
  • – Prohibited practices and AI literacy obligations apply from 2 February 2025
  • – Governance rules and GPAI model obligations apply from 2 August 2025
  • – High-risk AI embedded in certain regulated products can have an extended transition to 2 August 2027.
     
What matters operationally: your procurement teams and enterprise customers will start asking for evidence before the legal cliff-edge. “We’ll fix it in 2026” is not a procurement strategy.

3) Roles matter more than most teams realize

The EU AI Act assigns obligations across the chain: providers, deployers, importers, distributors (and, in some scenarios, authorized representatives). 

 

 

For CISOs and DPOs, the key is not memorizing definitions—it’s ensuring you can answer these questions per system:
  • Are we the provider (we develop and place it on the market / put into service under our name)?
  • Are we the deployer (we use it professionally in our operations)?
  • Are we an importer/distributor (we bring it into the EU market chain or resell)?

Why this is painful: if a business unit “customizes” or materially modifies a vendor system, the organization can drift into provider-like responsibilities. This is where governance needs a hard line: what counts as configuration versus modification, what triggers re-assessment, who signs off.

4) What the Act expects for high-risk AI (The requirements CISOs/DPOs should translate into controls)

The high-risk requirements cluster into a set of lifecycle disciplines. You’ll see them repeatedly in Articles 9–15 and the surrounding obligations. 

4.1 Risk management must be continuous, not ceremonial

High-risk AI requires a risk management system that runs throughout the lifecycle—identify, analyze, evaluate, mitigate, test, and update. 

CISO angle: treat this like security risk management plus model risk. Integrate threat modeling (prompt injection, data poisoning, model inversion, abuse cases) into the AI risk cycle.

DPO angle: insist that “risk” includes fundamental-rights and privacy impacts, not just operational failure.

4.2 Technical documentation: if it’s not written down, it doesn’t exist

High-risk AI must have technical documentation prepared before placing on the market/putting into service, kept up to date, and aligned to required content (Annex IV). 
This is where many organizations choke because documentation is treated as an afterthought. Don’t do that. Create a “technical file” habit early—design intent, data sources, evaluation results, limitations, human oversight design, monitoring plan.
 

4.3 Record-keeping and logging are mandatory engineering requirements

High-risk AI must support automatic recording of events to enable traceability across its lifespan. 

CISO practical translation: define minimum logging fields (inputs/outputs where lawful, model version, confidence scores, user actions, overrides, decision rationale pointers, system events), plus retention and access control aligned to your ISMS.

DPO practical translation: define privacy-preserving logging—log enough for auditability without turning logs into a shadow PII database.

4.4 Transparency to deployers: your users must understand limits

Providers must supply information so deployers can use the system appropriately (the transparency/instructions concept). 
This is not marketing copy. It is operational guidance: intended purpose, known failure modes, required human oversight, and how to interpret outputs.

4.5 Human oversight must be designed, not declared

Human oversight is explicitly required to prevent or minimize risks to health, safety, and fundamental rights. 
CISOs should watch for “rubber stamp oversight” (a person clicks approve without understanding). DPOs should watch for “oversight theatre” (no real ability to contest outcomes).

Good oversight looks like:
  • – clear escalation paths,
  • – meaningful ability to override,
  • – training for the humans supervising,
  • – UI/UX that surfaces reasons and uncertainty,
  • – defined conditions where AI must not be used.

4.6 Accuracy, robustness, cybersecurity are not optional

High-risk AI must meet expectations around accuracy, robustness, and cybersecurity. 
CISO takeaway: treat the model and its pipelines as part of your attack surface. Secure the full chain: data ingestion, training, deployment, inference endpoints, model management, third-party components, and monitoring.

4.7 Post-market monitoring and serious incident reporting are operational obligations

Providers must run post-market monitoring based on a plan that is part of technical documentation.
And providers must report serious incidents to authorities under defined timelines (the Act frames reporting obligations in Article 73; public summaries commonly highlight reporting windows such as 15 days and faster reporting for severe/widespread events). 
For CISOs and DPOs, the operational implication is straightforward: you need an “AI incident” playbook that plugs into security incident response and privacy incident response. Otherwise you will miss reporting thresholds or lack evidence when asked.

5) What CISOs should do differently (beyond standard ISMS)

Most CISOs already run mature programs: asset management, supplier risk, secure SDLC, vulnerability management, incident response. The mistake is assuming AI is “just another app.”

High-risk AI requires a few additions:

Build an AI asset inventory that includes vendor “AI features”

Your CMDB or software inventory rarely captures embedded AI capabilities. You need an AI register that explicitly lists:
  • – AI features in enterprise platforms (ITSM, HR, CRM, fraud tools),
  • – third-party model/API dependencies,
  • – where model outputs influence decisions.
Annex III use cases are the lens: if the feature touches those areas, treat it as candidate high-risk. 

Create “model change control” triggers
Change management must define triggers that force re-validation:
  • – model version changes,
  • – training data refresh,
  • – prompt/template changes that alter behavior,
  • – feature engineering changes,
  • – threshold changes that affect decisions,
  • – vendor model upgrades.
Without this, you will not sustain compliance in steady state.

Expand threat modeling to AI-specific abuse paths
Include:
  • – data poisoning and training set contamination,
  • – prompt injection and tool hijacking (for agentic systems),
  • – model extraction attempts,
  • – membership inference risks,
  • – adversarial examples and evasion,
  • – monitoring bypass and logging tampering.
Tie these to controls and test plans, not just narratives.

6) What DPOs should do differently (beyond GDPR muscle memory)

DPOs are used to DPIAs, RoPAs, vendor DPAs, and data subject rights. High-risk AI adds pressure in three places:
Treat AI “purpose creep” as a primary risk

AI systems drift into new uses. A model built for “screening” becomes “ranking.” A tool meant to “assist” becomes “decide.” Purpose creep is where privacy and fairness risks spike.

Your governance needs explicit “intended purpose” statements and prohibited uses, enforced via approvals and controls. That ties cleanly into the Act’s expectation that systems are used per intended purpose and reasonably foreseeable misuse is considered. 
Align privacy impact work with AI impact work
In practice, run a combined assessment pack:

  • – data sources and lawful basis (where applicable),
  • – PII minimization and retention,
  • – bias and disparate impact considerations,
  • – explainability and contestability mechanisms,
  • – human oversight workflow

This avoids the classic failure mode where privacy review comes late and blocks deployment.

Demand privacy-preserving logging and monitoring design
Because the Act expects traceability/logging for high-risk AI, logs can quietly become sensitive datasets.
Set rules early: what is logged, how it is protected, who can access it, and how long it is kept.

7) The minimum “evidence pack” you should be able to produce on demand

If you want a practical readiness test, ask: “Could we produce these within 72 hours for any high-risk AI system?”

  • – AI system register entry (owner, purpose, risk class, deployment scope, vendor dependencies)
  • – Risk management record (identified risks, mitigations, residual risk acceptance) 
  • – Technical documentation pack (system description, data governance summary, evaluation results) 
  • – Logging/record-keeping design (what is recorded, where, retention, controls) 
  • – Human oversight design (roles, training, override, escalation) 
  • – Monitoring plan + operational dashboards (drift/performance/security signals) 
  • – Incident reporting workflow (criteria, triage, reporting path, evidence capture) 

If you cannot produce this, your program is not operational yet—it’s aspirational.

8) A realistic preparation roadmap (what to do in the next 90 days)

  • You do not need to solve everything at once, but you do need to start correctly.

    Weeks 1–4: Visibility and classification
    • Build a first-pass AI inventory (include vendor features).
    • Map likely Annex III exposure and regulated product embedding. 
    • Assign a single accountable owner per system.
    • Decide your role per system (provider vs deployer, etc.).

    Weeks 5–8: Controls and evidence design
    • Define risk assessment template aligned to lifecycle. 
    • Define logging and monitoring minimum standards. 
    • Define human oversight requirements (not just policy wording). 
    • Draft your “technical file” structure and evidence repository approach. 

    Weeks 9–12: Run it on one real system

    Pick one high-impact use case and operationalize the full flow:
    • assessment → testing → approval → monitoring → incident playbook.
      Your first implementation will be messy. That’s normal. The goal is to create a repeatable pattern, not a perfect artefact.

Closing view: high-risk AI compliance is an operating capability

The organizations that will handle the EU AI Act best won’t be the ones with the longest policies. They’ll be the ones that can show, quickly and consistently, how a high-risk AI system is governed, tested, monitored, and corrected over time. The Act’s structure makes that expectation explicit—risk management, documentation, logging, oversight, monitoring, and reporting. 
For CISOs and DPOs, the most practical stance is this: treat high-risk AI as a regulated service with lifecycle controls. Put it in your governance system, your supplier system, your incident system, and your audit system. Once it’s there, it becomes manageable.
